SUMMARY: The
District maintains monitor well facilities at 11 sites on former Fort Ord. The license for three of these sites, on
properties slated to remain under U.S. Army jurisdiction upon completion of the
Base Realignment and Closure (BRAC) process, is currently up for renewal. District staff has been working with the
Army to renew the license, which will be for a period of 25 years. The Army now charges administration fees to
process such licenses, and the total charge for this renewal is $3,584, as
shown on Exhibit 6-A. Of this total, $500 was included as a line
item in the Fiscal Year (FY) 2003-2004 District Budget, and has been paid. The remaining $3,084 was not known at the
time of the FY 2003-2004 budget development process, and will need to come from
the District’s budget contingency.
RECOMMENDATION: It is recommended that the Board authorize a
payment of $3,084 for Army administrative costs in processing the District’s
monitor well license renewal. This
payment will be made if this item is adopted along with the Consent Calendar.
BACKGROUND: The District has maintained monitor well
licenses with the Army since the first District-owned monitor wells were
constructed on Fort Ord in 1986. The
monitor well locations have been selected to fill in strategic data gaps in the
District’s ground water monitoring network in and near the Seaside Basin, and
the data collected from these sites provide valuable information regarding
long-term water quality and quantity of the ground water resources of the
area. The current monitor well license
renewal (License No. DACA05-3-96-508) is for sites FO-09, FO-10, and FO-11,
which are on lands that will remain in Army ownership after the base closure
process is completed. Other District
monitor and injection well facilities on former Fort Ord are located on
properties that are intended to be, or have already been, transferred from Army
ownership. Continued use of those
facilities is covered by separate easement agreements. It should be noted that staff contacted Army
representatives both locally and in Sacramento to inquire about a waiver of the
license renewal costs, but was informed that there is no option available to
waive such fees. The
Administrative Committee considered this item on October 14, 2003, and
recommended approval on a vote of 3 to 0.
IMPACT ON STAFF/RESOURCES:
Staff resources are not significantly affected
by maintenance of the District’s license and easements on former Fort Ord
lands. Funds for $3,084 of the license
renewal costs are available from the $12,400 Water Resources Division
contingency in the FY 2003-2004 budget (Summary of Expenditures by Division,
page 37, FY 2003-2004 District Budget).
